Imagining Interim Administration

Peace in Sri Lanka will depend very much on whether the GOSL
(Government of Sri Lanka) will allow for the implementation of an
interim administration in the north and east of the country, in the
pre***ly Tamil areas. Although the cessation of hostilities
brokered by the Norwegian is still in force, however, both the parties
are involved in the process of peace negotiations. In fact, the LTTE
withdrew from negotiations because it felt that the GOSL was not
serious about the implementation of an interim administration that
will be under the control of the LTTE.

Although the GOSL has agreed in principle to the provision of an
interim administration, there are many factors that impede its
implementation. The opposition of President Chandrika Kumaratunga to
the proposal remains as one of the most important obstacles. As far as
the LTTE is concerned, without an interim administration it would not
be possible for the outfit to obtain funds pledged for development and
reconstruction of the war-torn areas in the north and east. This is
the main reason why the LTTE refused to participate in the recent
donor conference organized in Tokyo. It is the argument of the LTTE
that without governmental machinery it would be difficult to obtain
funds that is needed to rebuild and settle internally displaced
people.

Prime Minister Ranil Wickermesinghe is not opposed in principle to the
call for an interim administration. In fact, one or two proposals that
were earlier sent to the LTTE through the good office of the Norwegian
government were rejected by the LTTE as something not very
significant. Lately, however, the LTTE has decided to look into the
Discussion Paper offered by the GOSL. Although the proposal offered by
the GOSL is not a full fledged formula for the setting up of an
interim administration, the LTTE not wanting to reject outright has
decided to look into it so that it could come out with an alternative
proposal.

Recently the LTTE has set up a panel of constitutional, legal and
political experts main from the Tamil Diaspora to examine the
Discussion Paper so that a new proposal could be forwarded to the GOSL
for consideration. In the next one or two week these experts would
gather in Paris for a detailed discussion of what the government has
offered and would come out with a new proposal that would be submitted
for the LTTE. If the LTTE agrees to this proposal, then it would be
sent to the government for consideration and implementation.

The LTTE has made it very clear that without an interim administration
it would not engage in peace talks. There are fears that if the
implementation of this is delayed, chances that the country might head
for another long protracted war. Anyway, the LTTE hopes that once it
sends its alternative proposal to the government, it is hoped that
government would not waste much time in implementing it.

For the LTTE, an interim administration is needed for variety of
reasons. First, it would constitute a good preparatory stage for the
devolution of political power to Tamils in the north and east. In this
respect, an interim administration set up could be a forerunner for
the eventual settlement of the ethnic problems in the country on the
basis of federal political structure. Second, an interim
administration with power concentrated in the hands of the LTTE would
provide it legitimacy and responsibility from an international
perspective. Third, an interim set up would be able to endow the LTTE
with the necessary funds to develop and reconstruct the north and
east, areas of major battles. Fourth, an interim set up would
recognize the LTTE as the sole representatives of Tamilsa reward and
honour for an organization that fought the cause of Tamils for more
than two decades.

While the LTTE welcomes the set up of an interim administration, it
does not want any kind of set-up. For instance, it is not very keen to
accept earlier types of provincial councils that did not have much
power and autonomy. What is wants the government to do is to provide
for radical structure that would endow the LTTE with much power and
authority to manage the affairs effectively without much constraints
imposed by the center. Thus, an interim administration in line with
the thinking of the LTTE would have to consider the following
dimensions.

First, an interim administration would have to recognize the following
fundamental aspects of the Tamil national questionthat Tamils
constitute a nation, they have the right to self-determination and
have a right to their homeland. In this respect, an interim
administration should not be construed as temporary solution, but
sowing the seeds for the ultimate derivation of substantial autonomy
for Tamils in the north and eastthe agreed basis for the eventual
settlement of the ethnic conflict.

Second, an interim administration should be conceptualized and
concretized outside the sphere of the Constitution. Since the
cessation of hostilities agreement was arrived outside the
Constitution, the same should be done to implement an interim
administration. Only at much later stage, one could talk about the
need to amend the Constitution.

Third, unlike the Discussion Paper, an interim administration to the
liking of the LTTE must recognize the powerful presence of the LTTE,
its control of the security apparatus, its control over vast tracts of
land in the north and east and its vigorous revenue collection system.
If these were denied to the LTTE, then an interim administration would
not serve the interests of the Tamil people. Moreover, it would be
impossible for the LTTE to relinquish control of these without
shifting the balance in favour of the GOSL.

Fourth, while the LTTE would not be opposed to the idea of
quasi-governmental structure having representatives from other ethnic
groups, it would not tolerate mechanisms introduced by the GOSL to
weaken the outfit. While members of the Muslim and Sinhala ethnic
groups would have some representation, they should not be constituted
to sabotage or wreck the *** of the LTTE.

Fifth, whatever structure is adopted for an interim administration, it
is important the government should listen and act on the advice of the
LTTE. Real power should rest with the LTTE and not the government. The
government might have the right to non-LTTE members, but advice must
be sought with the LTTE. LTTE alone would have the right to appoint
its own representatives both at the regional and district levels.

The above are some of the things that the LTTE would like to see in an
interim administration and there are others. Failure on the part of
the GOSL to take the LTTE proposal seriously might endanger the peace
process. If an interim administration proposal cannot be the basis for
the derivation of future substantial autonomy, then it likelihood that
the LTTE might be forced to go for a separate state.

It must be remembered that the LTTE has never given up the quest for a
separate state. Whether or not it goes for a separate state would
depend very much on the government's ability to recognize the
legitimate rights of Tamils in the country.

LTTE leader Velupillai Prabhakaran Great Heroes' day speech in
November last year. "We are prepared to consider favourably a
political framework that offers substantial regional autonomy and
self-government in our homeland on the basis of our right to internal
self-determination.

As already stated Sri Lankan state sponsored terrorism against Tamil
people is on the rise. The basic right to life and liberty of every
Tamil is in jeopardy under the oppressive rule of President Chandrika
Kumaratunga.***, ***, extra-judicial killings, disappearances,
torture etc. have become so common that even Amnesty International
appears to evince only superficial interest in such crimes against
humanity. According to a 1999 Amnesty International report "torture
has been among the most common human rights violations reported in Sri
Lanka."

Sri Lanka has ratified both the Convention on the Elimination of All
Forms of Discrimination Against Women and the Convention Against
Torture. In addition, Sri Lanka has also enacted enabling legislation
in the form of the Torture Act to give effect to the Convention
Against Torture. But in practice they remain a dead letter.

Today, the Tamil people are not only subject to a brutal war in the
Northeast which results in death and destruction, but they are also
routinely subject to indignities of arbitrary arrests, detentions
without trial,***, torture and *** under judicial custody by the
Sinhala armed forces.

There is a proverb in Tamil which says that it is foolish for a man to
be on the look out for a good omen while having a cat in his pouch. So
are the Tamil people today. Until they physically force the Sinhala
army to vacate the illegal occupation of our Tamil Homeland and cut
loose the chains of Sri Lanka's hegemonic rule, the woes of Tamils
will continue to multiply in geometric progression.
