Richard that's a BIG no-no. Taking images from a newssite is a
strictcopyright violation. The images are owned by the paper and/or the
photographer.

Taking other people's pictures and not even mentioning credit is
dishonorable...yes.

Those "hard gotten pictures" are copyrighted and just because you
foundthem does not make them exclusive to you. So unless if you have
the copyrights to the photos, you have no legal rights over them.

I did some looking around at this site, and this person is *not* J.
Barry Mittan. The owner of the page just gives credit for all the photos
on the site to him. This person never gives their name, from what I can

get in touch with them.

Richard,

you may want to take another look at this other site.  I have seen
J.B.Mittan being attributed to for a lot of pictures on a number of
boards, not only Tara's but other skaters' as well.  So, when I saw your
post, I was surprised and decided to take a look.  The site you referred
to is maintained by someone named Ashley (can't find her last name).  She
may be the one who copied the picture from your site, not J.B. Mittan.
She probably did not attribute it correctly.  Also, since you probably did
not take the picture yourself, it is possible that J.B. Mittan actually
did take the picture.  (I believe he usually takes pictures at skating
events.)

who is doing the ripping off here when you see the exact same pictures
AND words on two different Tara web sites. Most of the Tara pictures

You're looking for credibility here when you pit yourself against a
professional skating photographer? Try again.

Why would Barry have ANY reason to copy pictures from YOUR site when he
takes his own and they are excellent?

If you obtain your photos from "surfing the Web," you are obtaining them
without getting the rights to them. No doubt, you are using some of
Barry's photos without copyright. After all, he takes photos that may
appear on news sites as well as fan sites. You may claim you did this "to
make your web site full of pictures that you don't find on other Tara fan
web sites," but have you ever considered there's a reason you don't find
them there--because they are copyrighted, and others are not taking things
without seeking the rights to them?

Did it ever occur to you that maybe Barry doesn't link to your site
because you stole his photos and it's a cheaper way to exact revenge than
a lawsuit? (although that might be his next step if I were him)?

Did it ever occur to you that his warnings are not in the least bit
"churlish," but rather the simple, legal request of a creative person that
his copyrighted work not be stolen from him? And that to call this
"hypocritical" of him is highly ironic of you, seeing as how you're the
one who stole his photos, not vice versa (no matter how you're trying to
cover your tracks now)?

I don't know, pal, but to me you're looking like the lowlife in this scene.

J.B. Mittan *took* the photographs in the first place, Ricky. If you're using
his pics without linking back to his site, you're stealing them. Mittan very
kindly makes his photos available to all honest webmasters with the stipulation
that the web page properly attribute his work. You, a newbie to the web, are
blasting a respected and award-winning skating photographer who is extremely
helpful to webmasters. You should apologize immediately.

Peg, who has not yet used one of Mr. Mittan's photos on her page, but when it
happens, I will follow his rules to the letter, and I enjoy receiving his scans
and try to envision how to work his images into my pages. Further, I hope he
never stops his generosity with his pictures, because I and others are
genuinely grateful to him.

Let's see, you accuse a well known photographer of theft, and once the story is
revealed that you are the one not playing by the rules, it's now not a big
deal?

Richard, I'd like to see a public apology to J. Barry Mittan (not a generic
"Sorry", but a real "Mr. Mittan, I am sorry I accused you of theft, and I
apologize for my misuse of your copyrighted photos".

To everyone else: I can dream the above scenario, just like I dream of Tahiti
and Creme Brulee!

It IS that big of a deal.  Not only are you violating copyrights yourself
with the uncredited images on your site, but you have tried (whether
intentionally or not) to smear the reputation of Mr. Mittan.  Not only do
your accusations cast him falsely in a bad light, they also cast aspersions
on his business practices, since he does do business on the internet.

A public retraction of your earlier statements and a personal apology to Mr.
Mittan is the least you could (and should) do.  As someone who does some
business on the net myself, I can tell you I would be mad as hell and looking
for *** if someone made such false accusations about me, my practices, or
any of the websites I have authored.

Taking unfair and mean-spirited pokes at Michelle Kwan is one thing, and,
although I don't much care for your comments about her, they don't have any
negative impact on Michelle and it is your right to make them, I suppose.
Your comments about Mr. Mittan are on an entirely different wavelength!

For the record, I don't use any of Barry's stuff on either Tara or Amber's
websites simply because the filenames of his work cannot be changed and they
throw my organization of files all off-kilter.  Therefore, I simply don't use
them out of respect of his guidelines for using his work online.  You should
have the same respect for his work and the work of other photographers and
credit every photo on your site that is not your own.

You know the other thing about this whole business is that the one actually

Bugs has an interesting way of pronouncing some terms.  "Maroon" for "moron"
is one of many.  Nicer than just coming right out and saying it, plus it's
funnier.  Especially the way Bugs says it in his Brooklynese.
